Terms and Conditions.

Introduction.

a.  The Learning Hub is a provider of a tutoring  service to the Client. the Learning Hub is not a tutoring agency.

b.  You are referred to in this document as "the Client". You undertake the purchase of tutoring services on behalf of "the Student". "The Student" may be yourself or another person. "The Student" is the person who receives the tutoring service through sessions of tutoring.

c.  By purchasing tutor services from The Learning Hub, the client agrees to these terms and conditions which relate to The Learning Hubs' provision of a tutor.

d.  The Termination or Conclusion of the Agreement occurs when all obligations under this agreement are complete or discharged, excluding the ongoing undertakings in Section 3 of this document. Conclusion of the Agreement will typically occur at the end of the final lesson, but may occur at another time in accordance with Section 4 of this document.

General

a.  the Client acknowledges that these terms govern the legal rights and obligations between the Client and The Learning Hub. The Learning Hub reserves the right to alter these terms and conditions.

b.  No variation or alteration of these terms by the Client shall be valid unless expressly approved in writing by The Learning Hub.

c.  This agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales.

a.  The Client is not permitted to enter into any private arrangement with any Tutor working in the Learning Hub. The Client undertakes to make all bookings with Tutors exclusively through The Learning Hub.

b.  A breach of these terms will render the client liable to account to The Learning Hub for all sums received by the Tutor direct from the Client or from a new Client without deduction and the Learning Hub shall be entitled to seek injunction against the client to prevent further breaches. these obligations continue beyond the termination or conclusion of this agreement.

c. Should you wish to recommend one of The Learning Hubs tutors to any other Potential or Actual Client, that Client must contact The Learning Hub and make arrangements through The Learning Hub.

a.  If the Tutor is unable to complete the Course of Tuition, or the Client requests a replacement Tutor because they are not satisfied with the original Tutor assigned to them, The Learning Hub will endeavour to find a suitable replacement Tutor with regard to the level and subject for which tuition is required.

b.  If The Learning Hub is unable to find such a suitable replacement Tutor within a reasonable time, The Learning Hub will refund any fees pre-paid by the Client representing the number of sessions that the Tutor or any replacement Tutor has been unable to complete.

c.  If the replacement tutor meets the Learning Hub's criteria for suitability for the job in terms of subject and level knowledge and is available at the same time or another time convenient to the Client, then The Learning Hub has fulfilled its obligations; if the Client then wishes to terminate the Tuition mid-course, the provisions of paragraph 4d will apply.

d.  If the Client wishes to terminate the Tuition mid-course for any reason, no refunds can be granted for the balance of the sessions that have been taught; furthermore, one weeks notice must be provided. In that week the Client may choose to utilise the Session or Sessions that were planned to occur during that week, or nor, but will not be refunded if the Client chooses not to utilise the Session or Sessions during that week. The Learning Hub will refund all monies prepaid excluding fees for the sessions that have already been taught and those fees for the week following the notification of Termination.

a.  The Client can pay either by bank transfer, in cash or by card.

b.  The Client will pay in advance of, or on the day each lesson. No lessons can be paid for in arrears. In the case of the Client receiving online tuition or tuition at their home, lessons will be paid for a minimum of 24 hours in advance. Tuition will not be provided if payment has not been received in due  time.

 The Learning Hub does not accept any liability for the consequences of tuition, including, but not limited to, exam results and dissertation scores.

a.  Clients should be aware that there can be considerable preparation involved before each Session of tuition.

b.  Notice of a scheduled tutoring session for any reason whatsoever must be given by the Client to The Learning Hub no less than 24 hours prior to the scheduled session.

c.  If notice of cancellation of a scheduled tutoring Session is given within 24 hours of the start of the Session, then the Client will be charged with the full payment for that tutoring session, unless The Learning Hub deems the cause of cancellation to be exceptional circumstances and agrees not to accept payment for the session. If the Client cancels more than 24 hours prior to the scheduled session, then the Client will be charges half rate to retain the reserved day and time of the sessions. If the retainer fee is not paid The Learning Hub cannot guarantee to hold the place.

d.  Should the tutor not be available on the day, the Client will be informed, and a rearranged time may be offered by The Learning Hub. If the Client has already paid for the Session and a suitable session cannot immediately be arranged, this will be a credit Session that the Learning Hub and Client can arrange in the future.

e.  If a Session falls on a Bank Holiday or other national or religious holiday that either the Tutor or the Client wishes to observe, then an alternative session must be arranged with The Learning Hub.

f.  If the student is ;late for a Session, the tutor may choose to, but is not obligated to, work beyond the scheduled end time.  If the Tutor stops work at the scheduled end time, the Session will be charged at the usual price. If a Tutor is late for a Session, then it is the duty of the tutor to arrange to make up the lost time.

g.   If the Student or Client chooses to terminate an Session early, the Session will be charged at the full price.

h.  Cancellations by the Client of more than 3 weeks in succession, or that which The Learning Hub perceive as unreasonable, regular cancellations, will be considered for immediate termination of agreement, at The Learning Hub's discretion.

 

 

 

The Client agrees that they will not disclose any confidential information concerning the Tutor or The Learning Hub to any person for the duration of this agreement and for a period of 5 years after termination of the agreement, save as required by law, court order or any government or regulatory authority. The Learning Hub will use the information provided by the Client to deal with the administration of the Services and to assist in placing the Student with a suitable Tutor. client and Student information will not be shared with any outside agency.                    .
